general

Photographic prints and books can be influenced by environmental influences. The materials and dyes used can change slightly over time . So that you can enjoy our plants in the long term, you should not expose them to direct sunlight. So, do not hang directly over heaters and do not expose to excessive humidity. The works are therefore not suitable for an outdoor area, cellar rooms, kitchens or bathrooms.

The aim of these terms and conditions is to regulate the business relationship between you and us in a uniform, binding and fair manner. The following general terms and conditions are, therefore, with knowledge and acceptance, always a prerequisite for a contract. By placing an order with us you acknowledge and confirm the terms and conditions.

 

scope

For all orders via our online shop “theRBook.com”, the following general terms and conditions apply, in the version valid at the time of the order.

Conditions deviating from these general terms and conditions are not recognized unless we expressly agree to their validity in writing.

 

presentation

We strive to present the properties of our products exactly. However, the color display depends on your computer system and we cannot guarantee that your computer will accurately reproduce the colors.

 

conclusion of contract

The presentation of the products in the online shop does not represent a legally binding offer, but a non-binding online catalog. You can use the “Add to shopping cart” button to select products that will be displayed in a summary of the order process at the end of the ordering process. By clicking the “Buy Now” button, you are making a binding declaration that you want to purchase the products listed there (offer). With the receipt of your order we will automatically accept your offer. You will receive an order confirmation by email, in which the details of your order are listed again.

The text of your order is saved by us and can be sent to you on request after your order has been completed.

 

delivery

Unless otherwise agreed, delivery will be made from our location to the delivery address you specified. The delivery time is approx. 6 working days within Germany and approx. 8 or more days abroad.

 

prices and payment

The prices stated in the online shop include VAT. The shipping costs are not included in the price of the order and will be added.

The purchase price is paid by credit card, PayPal or bank transfer before delivery (prepayment).

 

retention of title

The delivered goods remain the property of Frank Kayser until full and final payment.

 

shipping

Please select the desired country when ordering online, the shipping costs will be displayed accordingly. Depending on the size, weight and destination, the shipping costs may have to be calculated.

 

liability

TheRBook.com is fully liable for damage within the framework of the statutory provisions

(a) from injury to life, limb or health, which is based on an intentional or negligent breach of duty or otherwise on willful or negligent behavior by Printa.Gallery or one of its legal representatives or vicarious agents;

(b) which are based on an intentional or grossly negligent breach of duty or otherwise on deliberate or grossly negligent behavior on the part of the provider or one of his legal representatives or vicarious agents.

TheRBook.comis liable for damages that are based on a slightly negligent breach of essential obligations by Printa.Gallery or one of its legal representatives or vicarious agents, limited to compensation for the foreseeable damage typical for the contract. Essential duties are duties, the fulfillment of which enables the orderly execution of the contract in the first place and on the observance of which the customer can rely.

The above provisions apply mutatis mutandis to the liability of theRBook.com with regard to the reimbursement of futile expenses.

Liability under the Product Liability Act remains unaffected.

 

warranty

The statutory warranty period of two years applies, starting with the delivery of the goods. Within this period, all defects will be rectified free of charge, provided they are subject to the statutory warranty obligation.

If you as a customer are an entrepreneur according to § 14 BGB, your claims for defects are subject to the statutory inspection and notification obligations (§§ 377, 381 HGB). If you discover a defect during the inspection or later, please inform us immediately in writing. If you notify within two weeks, the timely dispatch is sufficient to meet the deadline. Obvious defects (including incorrect and short delivery) must be reported to us in writing within two weeks of delivery. Here too, timely dispatch is sufficient to meet the deadline. If you do not meet these obligations, our liability for the undisclosed defect is excluded.

 

no granting of rights

When you purchase a photographic print, you only acquire real ownership of the print. You do not acquire any other usage rights. Reproduction (duplication), distribution, rental, public access or other analogue or digital exploitation are not permitted unless this is permitted by law. However, you are free to resell the print.

 

dealing with personal data

All regulations for the protection of your data can be found under privacy policy.

 

alternative dispute resolution

We are not obliged and are not prepared to participate in dispute settlement procedures before a consumer arbitration board. In the event of complaints, a personal conversation is always required to find a solution.
